Copyright

Copyright in the UAE is an exclusive legal right of the owner of the creative work. It is considered to be the right to copy or reproduce the same. The provision which governs the copyright law is The Federal Law No. 7 of 2002 in respect of Author Copyright and Parallel Rights and is defined as having a diverse array of original and tangible works such as books, music, artistic, lectures, photographs, computer software, and other similar creations that are subject to copyright protection. The period of copyright protection for the author or composer of their work is secured from the time the work originated until a period of 50 years.

Trademark

A trademark is a particular mark or design which is protected for an individual’s good or services provided. The law is primarily governed by Federal Law No. (37) of 1992 on Trademarks, as amended by Federal Law No. (8) of 2002. The regulatory authority which supervises trademark are:

  • The Ministry of Economy
  • The Trademark Registry Office
  • The International Property Rights Department
Patent

The provision which deals with the patents in UAE is by Federal Law No. 11/2021, which ensures the protection and relation of patents related to inventions. There are certain criteria such as novelty, inventive step, and industrial applicability required to meet for an invention to be patentable. 

Designs

Designs in The UAE are governed under the Federal Law No. 44 for the year 1992 pertaining to the Industrial Regulation and Protection of Patents, Industrial Drawings and Designs which was replaced by Federal Law No. 17 for the year 2002 and later amended by the Federal law 31 for the year 2006.

Legal Authority

The competent authority which regulates the Intellectual Property Rights in UAE is Ministry of Economy. The registration of all intellectual work is done under the given authority.
